Terms and Conditions

HOW TO ENTER

To enter, entrants must visit www.rainharvesting.com.au, follow the prompts to the Rainwater Knowledge Centre page, either ask a question or join the online tank maintenance program, input the requested details including first name, suburb, country, email address and submit the fully completed entry form during the promotional period.

TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. The Promoter is Rain Harvesting Pty Ltd (ABN 11 113 300 093) of 28-34 Reginald Street, Rocklea, Brisbane QLD 4106, Australia.

3. Entry to the competition requires the entrant to consent to receiving future emails and marketing communication by either asking the Rainwater Knowledge Centre a question or joining the Online Rainwater Tank Maintenance Program. It is free to ask a question or join the Online Rainwater Tank Maintenance program. Only one entry per person per month.

4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

5. The competition is only open to permanent residents of Australia. Rain Harvesting reserves the right to request the winner to provide identity and residency prior to awarding the prize. Identification considered suitable for verification is at the discretion of the Rain Harvesting.

6. Incomplete, indecipherable, or illegible entries will be deemed invalid.

7. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

8. The competition commences on 18/06/10 and will close at 11.59pm on 31/05/2011. The draw will take place at Rain Harvesting at Level 1, 44 Jordan Terrace, Bowen Hills, Brisbane QLD 4006, Australia. The monthly draws will occur on the following dates:

• June 2010 monthly prize will be drawn on Friday, 2nd July 2010 at 2pm AEST
• July 2010 monthly prize will be drawn on Tuesday 3rd August 2010 at 2pm AEST
• August 2010 monthly prize will be drawn on Thursday 2nd September 2010 at 2pm AEST
• September 2010 monthly prize will be drawn on Monday 4th October 2010 at 2pm AEST
• October 2010 monthly prize will be drawn on Tuesday 2nd November 2010 at 2pm AEST
• November 2010 monthly prize will be drawn on Thursday 2nd December 2010 at 2pm AEST
• December 2010 monthly prize will be drawn on Tuesday 11th January 2011 at 2pm AEST
• January 2011 monthly prize will be drawn on Wednesday 2nd February 2011 at 2pm AEST
• February 2011 monthly prize will be drawn on Wednesday 2nd March 2011 at 2pm AEST
• March 2011 monthly prize will be drawn on Monday 4th April 2011 at 2pm AEST
• April 2011 monthly prize will be drawn on Tuesday 3rd May 2011 at 2pm AEST
• May 2011 monthly prize will be drawn on Thursday 2nd June 2011 at 2pm AEST

9. Winners will be notified by email and the winner’s names will be published on www.rainharvesting.com.au. The Promoter’s decision is final and no correspondence will be entered into.

10. The monthly winner will win a $200 Woolworths Wish Card.

11. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

12. Each prize is valued at $200. Total prize pool value is $2,400.00.

13. The prize is not transferable or redeemable for cash.

14. In the event that any prize is not claimed within 3 months of the draw date, an unclaimed prize draws will take place on the following dates at Rain Harvesting at Level 1, 44 Jordan Terrace, Bowen Hills, Brisbane QLD 4006, Australia:

• June 2010 unclaimed monthly prize will be drawn on Monday 4th October 2010
• July 2010 unclaimed monthly prize will be drawn on Wednesday 3rd November 2010
• August 2010 unclaimed monthly prize will be drawn on Thursday 2nd December 2010
• September 2010 unclaimed monthly prize will be drawn on Tuesday 4th January 2011
• October 2010 unclaimed monthly prize will be drawn on Wednesday 2nd February 2011
• November 2010 unclaimed monthly prize will be drawn on Wednesday 2nd March 2011
• December 2010 unclaimed monthly prize will be drawn on Monday 11th April 2011
• January 2011 unclaimed monthly prize will be drawn on Monday 2nd May 2011
• February 2011 unclaimed monthly prize will be drawn on Thursday 2nd June 2011
• March 2011 unclaimed monthly prize will be drawn on Monday 4th July 2011
• April 2011 unclaimed monthly prize will be drawn on Wednesday 3rd August 2011
• May 2011 unclaimed monthly prize will be drawn on Friday 2nd September 2011

15. Prizes will only be delivered in Australia and each winner should allow 28 days from the prize draw for delivery of their prize.

16. All correct and valid entries submitted during the competition will be entered into the prize draw to win the nominated prize. All entries are deemed to be received at the time of receipt into Rain Harvesting’ database, and NOT at the time of transmission by the entrant.

17. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

18. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

19. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

20. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

21. Competition entrants consent to Rain Harvesting using the entrant's name, state of residence and photo in the event that they are a winner in any media, including advertising, and agrees to participate in any promotional activities for Rain Harvesting, without payment, for the purposes of promoting this competition and promoting Rain Harvesting.

23. Employees of Rain Harvesting and its subsidiaries are not eligible to enter.
